Who we are. Pueblo Merch (“PuebloMerch.com,” “we,” “us,” “our”) operates the website and online store at https://www.pueblomerch.com (the “Services”). Our store is hosted on Shopify.

By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1) Eligibility & Accounts

  • You must be the age of majority in your jurisdiction.

  • You may allow your minor dependents to use the Services on devices you own/manage.

  • You agree to provide accurate, current, and complete information.

  • You’re responsible for safeguarding your credentials and all activity on your account. Accounts may not be sold, assigned, or transferred.

2) Products & Content

We work to describe products accurately, but colors and appearance may vary by device settings. Descriptions, availability, and pricing may change without notice. We may limit quantities by person, household, region, or order.

3) Orders & Cancellations

Placing an order is an offer to purchase. We accept your order only after payment is processed and we send confirmation. We may cancel or refuse any order (e.g., suspected fraud, stock issues) and will attempt to notify you via the contact details provided.
Returns and exchanges follow our Refund Policy.
You confirm purchases are for personal/household use and not for resale or export.

4) Prices, Taxes & Billing

Prices, discounts, and promotions may change without notice. The price at checkout is the price in effect at the time of order and excludes taxes, shipping, duties, and import fees unless stated.
You agree to keep payment details (including card expiration) up to date and authorize us to charge the total shown at checkout plus applicable taxes/fees.

5) Shipping & Delivery

Delivery dates are estimates and not guarantees. We are not liable for carrier delays, customs processing, or events outside our control. Title and risk of loss pass to you when we hand the order to the carrier.

6) Intellectual Property

All content on the Services (text, graphics, images, video, audio, designs, and arrangements) is owned by PuebloMerch.com or its licensors and is protected by applicable laws. You may use the Services for personal, non-commercial purposes only. No rights are granted except as expressly stated.
PuebloMerch.com names, logos, and marks are our trademarks. Shopify’s names and marks are trademarks of Shopify. Other marks belong to their respective owners.

7) Third-Party Tools & Links

We may provide access to third-party tools and link to third-party sites. These are provided as-is without warranties or endorsements. Use them at your own risk. Review third-party terms and policies before engaging in any transaction; questions or issues should be directed to the third party.

8) Relationship with Shopify

Our store is powered by Shopify, but any purchases are made directly with PuebloMerch.com. Shopify is not responsible for any sales, products, services, or related claims. You release Shopify and its affiliates from claims arising from your transactions with PuebloMerch.com.

9) Privacy

Your use of the Services is subject to our Privacy Policy. Because we are hosted by Shopify, certain personal information is processed by Shopify to operate and improve the Services. See Shopify’s privacy disclosures and our Privacy Policy for details.

10) Feedback & Reviews

If you submit ideas, reviews, or other content (“Feedback”), you grant us a worldwide, perpetual, sublicensable, royalty-free license to use, reproduce, modify, publish, and display it for any purpose. You represent you have the rights to submit the Feedback and that it complies with applicable laws and these Terms. We may remove content we deem unlawful, infringing, or objectionable.

You may not use the Services to:

  • send misleading, spam, or malicious code;

Information on the Services may contain errors or omissions (e.g., descriptions, pricing, availability). We may correct or update information and cancel orders based on inaccurate information at any time, including after an order is submitted.

13) Warranty Disclaimer

Except as expressly stated by PuebloMerch.com, the Services and all products are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted, timely, secure, or error-free operation. Some jurisdictions do not allow certain disclaimers; those limits may not apply to you.

14) Limitation of Liability

To the fullest extent permitted by law, PuebloMerch.com and our officers, employees, partners, agents, contractors, service providers, and licensors (and Shopify and its affiliates) are not liable for indirect, incidental, special, consequential, punitive, or similar damages (including lost profits, revenue, savings, data, or replacement costs) arising from your use of the Services or products, even if advised of the possibility. Our total liability for any claim will not exceed the amount you paid for the applicable product or, if the claim does not relate to a product, USD $100.

15) Indemnification

You agree to indemnify and hold harmless PuebloMerch.com, Shopify, and our respective affiliates, officers, directors, employees, and agents from claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of your (a) breach of these Terms, (b) violation of law or third-party rights, or (c) use of the Services. We may control defense and settlement; you will cooperate as reasonably requested.

16) Termination

We may suspend or terminate your access at any time. You remain responsible for amounts due up to the termination date. Sections intended to survive (including IP, Feedback, Disclaimers, Liability Limits, Indemnification, Governing Law, Assignment, Severability, and Entire Agreement) survive termination.

17) Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign or delegate these Terms without notice.

18) Severability

If any provision is unlawful, void, or unenforceable, it will be enforced to the maximum extent permitted, and the remainder will remain in effect.

19) Waiver & Entire Agreement

Failure to enforce a provision is not a waiver. These Terms, together with posted policies (including the Privacy Policy and Refund Policy), constitute the entire agreement between you and us regarding the Services.

20) Governing Law & Venue

These Terms are governed by the laws of the State of Colorado, USA, without regard to conflicts principles. You consent to exclusive jurisdiction and venue in the state or federal courts located in Pueblo County, Colorado.

21) Changes to These Terms

You can review the current Terms on this page. We may update them by posting a revised version with a new “Last updated” date. Material changes will be notified as required by law. Your continued use after changes means you accept the updated Terms.
